抗ＰＤ－１抗体等に関する特許（いわゆる「本庶特許」）の特許権者である本庶佑氏（Tasuku Honjo）及び小野薬品工業（Ono Pharmaceutical）とダナ・ファーバー癌研究所（Dana-Farber Cancer Institute）のゴードン・フリーマン氏（Gordon Freeman）との間で争われている共同発明者を巡る裁判。
前回記事では、欧州でも、「本庶特許」のうち少なくとも欧州特許出願（EP10161767.8; publication no. EP2206517）について、ゴードン・フリーマン氏から権利譲渡を受けたダナ・ファーバー癌研究所が、特許発明に係る権利者としての地位を求めてEPC第61条1項に従った権利取得手続きを請求していることを紹介しましたが、さっそく、3月2日にミュンヘン第一地方裁判所（Munich I Regional Court）の判断が下されたようです。
2023年3月9日及び13日に各代理人から欧州特許庁（EPO）に提出された資料によると、裁判所はダナ・ファーバー癌研究所の請求はすでに時効を迎えていたと判断したようです。
しかし、ダナ・ファーバー癌研究所はこの判決を不服として3月3日に控訴したとのことです。
”Munich I Regional Court has rescheduled the date for the pronouncement of the decision in the co-entitlement case to 2 March 2023 and has dismissed the claims brought by Dana Farber in their entirety.”
“In the entitlement proceedings before the Munich I Regional Court (“Court”) initiated by Dana Farber regarding EP 2 206 517 (Application No. 10 161 767.8, “EP 517”) as well as its divisional EP 3 287 144 (Applicaiton No. 17 196 173.3, “EP 144″), the decision was rendered on 2 March 2023. The Court ruled that the alleged co-entitlement claims of Dana Farber to the two applications are time-barred.”

“However, the decision is not a final decision. An appeal has been filed by Dana Farber Cancer Institute (DFCI) with the Munich Higher Regional Court (OLG München) on March 3, 2023”.
